California Bar Exam Essay Subjects Tested On Mcat

Subjects Tested

MBE Subjects: Civil Procedure, Constitutional Law, Contracts/Sales, Criminal Law/Procedure, Evidence, Real Property, Torts.

Texas Essay Subjects: Business Associations, including Agency, Corporations, Partnerships, Limited Liability Companies and Professional Associations, Trusts and Guardianships, Wills and Administration, Family Law, Uniform Commercial Code, Consumer Rights, including DTPA and Insurance, Real Property, including Oil and Gas.

Potential Essay Crossover topics: Income, Estate, and Gift Tax Issues (to be included where appropriate, as an element of questions in other subjects, such as Family Law, Oil and Gas, Wills, etc.), Bankruptcy (to be included where appropriate, as an element of questions in other subjects, such as Family Law, Wills and Estates, Real Property, etc.)

Procedure and Evidence Topics: Texas Civil Procedure and Evidence, including Jurisdiction. Federal and Texas Criminal Procedure and Evidence.

Bar Exam Dates

In 2018, the Texas Bar Exam will be administered on

  • February 27, 28 & March 1, 2018
  • July 24, 25, & 26, 2018

Grading

The Texas Bar Exam will require a minimum scaled combined score of 675 points out of 1000 points to pass. The MBE is weighted at 40% of the score, the Essays are weighted at 40%, the MPT is weighted at 10% and the Procedure and Evidence section is weighted at 10%.

Day 1: 

  • Morning: 3 essays (3 hours)

  • Afternoon: 2 essays (2 hours) and one 90-minute performance test

Day 2:

  • Morning: 100 MBE multiple choice questions (3 hours)

  • Afternoon: 100 MBE multiple choice questions (3 hours)

Topics tested on the Essay portion of the exam: Business Associations, Civil Procedure (Federal & California), Community Property, Contract/Sales, Constitutional Law, Criminal Law & Procedure, Evidence (Federal & California), Professional Responsibility, Real Property, Remedies, Torts, Wills & Trusts

Performance Test: Examinees are asked to draft either memos, discovery documents or arguements using a "closed universe of facts", case laws, statutes etc.

Topics tested on the MBE: Contracts, Civil Procedure, Constitutional Law, Criminal Law & Procedure, Evidence, Real Property, Torts
